FormSnake is a software platform that helps you complete government forms. We are not a law firm and we do not provide legal advice. We strongly recommend consulting a qualified attorney before submitting any forms to a government agency.
1. Acceptance of Terms
By accessing or using the FormSnake platform (the “Service”), operated by FormSnake LLC (“FormSnake,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
2. Description of Service
FormSnake is a software platform that assists users in completing government forms. The Service validates user-provided information against known form requirements, generates completed form documents, and assembles filing packages for download.
3. No Legal Advice
FormSnake is not a law firm, does not provide legal advice, and is not a substitute for the advice of a qualified attorney. The Service is a software tool only. We do not guarantee that any form completed using the Service will be accepted by any government agency. Users are solely responsible for the accuracy and completeness of all information they provide. We strongly recommend consulting a qualified, licensed attorney before submitting any completed forms to a government agency.
4. User Responsibilities
By using the Service, you agree to:
- Provide accurate, truthful, and complete information when completing forms
- Use the Service only for lawful purposes
- Maintain the security of your account credentials and not share them with others
- Carefully review all completed forms and filing packages before submission to any government agency
- Comply with all applicable laws and regulations in your jurisdiction
5. Limitation of Liability
To the maximum extent permitted by applicable law:
- FormSnake's total aggregate liability for any and all claims arising out of or related to the Service shall not exceed the amount you actually paid to FormSnake for the specific service giving rise to the claim.
- FormSnake shall only be liable for direct damages that are proximately caused by a proven, material error in the software.
- FormSnake shall not be liable for: rejection of any form by any government agency; incorrect, incomplete, or misleading information provided by you; delays in government processing; any consequential, incidental, indirect, special, or punitive damages; lost profits or revenue; legal fees or costs; or any damages arising from your failure to review completed forms before submission.
- FormSnake shall not be liable for changes in government form requirements, regulations, or procedures that occur after your filing package has been generated.
6. Indemnification
You agree to indemnify, defend, and hold harmless FormSnake LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) any information you provide through the Service; (c) your violation of these Terms; or (d) your violation of any applicable law or regulation.
7. Intellectual Property
The Service, including its software, design, text, graphics, logos, and all other content, is the property of FormSnake LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
You retain ownership of all personal data and information you provide through the Service. By using the Service, you grant us a limited license to use your data solely for the purpose of providing the Service to you.
8. Payment and Refunds
All sales are final. Refunds are available only when a filing package contains a demonstrable software error in the form-filling process that materially affects the usability of the completed forms. Any refund shall be limited to the amount paid for the specific filing package in question. Refund requests must be submitted within 30 days of purchase.
9. Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to the Service, other users, or third parties. You may delete your account at any time by contacting us.
10. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association. Arbitration shall be conducted on an individual basis only — you waive any right to participate in a class action, class arbitration, or any other representative proceeding. The arbitration shall take place in the State of Delaware, and the arbitrator's decision shall be final and binding.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
11. Warranty Disclaimer
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. FormSnake does not warrant that the Service will be uninterrupted, error-free, or completely secure, or that any form completed using the Service will be accepted by any government agency.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FormSnake LLC regarding the Service and supersede all prior agreements, representations, and understandings.
14. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Service or by email. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.
15. Recommendation to Seek Legal Counsel
We are not lawyers. These Terms are written to protect both parties. We strongly recommend that you have a licensed attorney review any legal documents — including these Terms and any completed government forms — before relying on them. Your use of the Service does not create an attorney-client relationship with FormSnake.
